By accessing or using the Index, you (and any entity on whose behalf you act) agree to these terms. You are responsible for anyone or anything, including AI tools, acting for you or at your direction. If you do not agree, do not access or use the Index.

Ownership

The SemiAnalysis GPU Pricing Index (the “Index”) includes the H100, A100 and B200 Spot-Contract Composite Indexes and the prices shown at semianalysis.com/gpu-pricing-index/. SemiAnalysis LLC (“SemiAnalysis”) retains all ownership rights, title and interest in and to the Index, including all intellectual property rights. All rights not expressly granted in these terms are reserved, and no license or right is granted by implication, estoppel or otherwise.

Permissions

  • You may, without asking us:
    • View the Index; and
    • Use screenshots of the Index, or quote individual values from it, in one-off works such as articles, reports, research notes, presentations and social media posts. Commercial works are included. Credit “SemiAnalysis GPU Pricing Index” and, where you can, link to semianalysis.com/gpu-pricing-index/.
  • You need written permission from SemiAnalysis to:
    • Collect Index data systematically or repeatedly, by scraping, automated download or any other automated means;
    • Store Index data in a database, data feed or data pipeline, or include it in a product, service, recurring publication, index, benchmark or financial instrument; or
    • Use Index data to train, fine-tune, develop, improve or evaluate machine learning models.

THE INDEX IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, SEMIANALYSIS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SEMIANALYSIS, ITS AFFILIATES AND THEIR RESPECTIVE PERSONNEL WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGES ARISING FROM THE INDEX OR THESE TERMS, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY.

No Duty to Update

The Index may be revised, restated, delayed, suspended or discontinued at any time. SemiAnalysis has no duty to update or correct it.

No Advice, Reliance or Relationship

The Index is not investment, legal, tax or other advice, and is not an offer, solicitation or recommendation to buy, sell or enter into any transaction. Your use of the Index creates no advisory, fiduciary or other relationship with SemiAnalysis. You are solely responsible for your use of the Index, and you do not rely on SemiAnalysis for any decision.

Other Terms

These terms supplement the SemiAnalysis Terms and Conditions (semianalysis.com/terms-and-conditions). If these terms conflict with the Terms and Conditions as to the Index, these terms control. A license or other agreement signed by SemiAnalysis controls over these terms. SemiAnalysis may change these terms at any time. The version on this page at any given time replaces all earlier versions.
